Bylaw 2002-33 (as amended)

A Bylaw of the Town of Rosthern to fix the rates to be charged for the use of Water and Sewer Services.

Appears as amended by 2003-06, 2005-02

WHEREAS the Council of the Town of Rosthern deems it necessary to fix water and sewer rates at a level which will provide financing for expansion of the water supply, and,

WHEREAS it is consistent with water conservation policy to discourage high-volume use of water, and,

WHEREAS an equitable system of fixing water and sewer rates does not penalize the low-volume consumer,

NOW THEREFORE in accordance with Section 184 of The Urban Municipality Act, 1984 the Council of the Town of Rosthern in the Province of Saskatchewan enacts as follows:

  1. Except as provided in section 9, all water consumers shall pay to the Town the rates set forth in section 2 of Schedule “A” of this bylaw for each 1,000 gallons of water, or fraction thereof, that may be consumed.

  2. Except as provided in section 9, all persons who own or occupy real property drained, or required to be drained, into the sanitary sewers of the Town shall pay for such service a quarterly rent or service charge in accordance with the schedule set out in section 3 of Schedule “A” to this bylaw.

  3. In this bylaw:

    (a) “Commercial” water customers are all self-contained businesses, including those with residences located in the same building.

    (b) “Commercial 1" sewer customers are users with normal waste.

    (c) “Commercial 2" sewer customers are users with industrial waste, such as restaurants, hairdressers, meat shops, car washes, garages, etc.

    (d) “Institutional” water and sewer customers are schools, hospitals and nursing homes.

    (e) “Nonprofit organizations” include municipalities, churches and service clubs.

    (f) “Residential” water and sewer customers are those not included in definitions (a), (b), (c), (e), (f) and (g) and (h).

    (g) “Water Dispensing Centre” shall mean all water sold to the public at the Water Dispensing Centre.

    (h) “Recreational” shall mean the Valley Regional Park - Rosthern.

    (i) “Low-volume” sewer customers are those that consume 6,000 gallons of water or less per billing period.

    (j) “High-volume” sewer customers are those that consume more than 6,000 gallons of water per billing period.

  1. All water consumers who do not own property serviced shall pay for every water meter installed in any water connection to the water system of the Town, the deposit required by Section 1 of Schedule “A” to this bylaw as a condition of the Town supplying water to the said consumer. The said deposit shall be refunded to the consumer when service to such consumer is discontinued and the meter is removed.

  2. Where a water meter is damaged due to a consumer’s act or omission, the cost of repair or replacement of the meter shall be borne by the consumer.

  3. All water consumers shall pay to the Town a fee of $25.00 for turning on any water connection.

    (a) If the re-connection to reinstate the said service is at a time other than the municipal employees’ regular working hours, the re-connection fee shall be $40.00.

  1. A consumer may, on request, have a water meter checked for accuracy on payment of a $15.00 fee, provided that the fee shall be refunded to the consumer should the meter be found to be faulty through no fault of the consumer.

    (a) Council may from time to time fix, by resolution, the fee to be charged for the various types of service connections.

  1. No water or sewer rates shall be payable after disconnection if a water connection has been turned off at the street by the servants of the Town at the request of the consumer.

  1. A minimum water and sewer charge of $8.00 per month shall apply where a consumer has notified the Town that no water will be used but has not requested discontinuance of service or the removal of the meter.

  2. All water and sewer accounts shall be rendered quarterly.

  3. All water and sewer accounts are due and payable when rendered. If water and sewer rates and charges are unpaid after thirty days from the date of mailing the account, service may be discontinued without notice and a penalty of 2% per month on any unpaid amounts after 60 days from the ending date of the billing period shall be charged.

  4. All rates, costs or charges imposed by this bylaw remaining unpaid after December 31, may be transferred to the tax roll of the Town and may be levied and collected in like manner as municipal rates and taxes are by law recoverable.

  5. Every person who contravenes any provision of this bylaw is guilty of an offence and liable on summary conviction to a fine of not more than $1500.00 but not less than $65.00.

  6. Bylaw 2002-14 is hereby repealed.

  7. This bylaw shall come into force and take effect on the date of approval of the Saskatchewan Municipal Board.

SCHEDULE “A” TO BYLAW 2002-33 as amended

  1. WATER METER DEPOSITS
    1. If the consumer owns the property serviced there will be no charge.
    2. If the consumer does not own the property serviced, deposits are as follows:
      1. 5/8 inch meter 220.00
      2. 3/4 inch meter 290.00
      3. 1 inch meter 360.00
      4. 1½ inch meter 585.00
      5. 2 inch meter 720.00
  1. WATER RATES

    The following rates shall apply:

    • Commercial $ 6.00 per 1000 gallons
    • Institutional $ 6.00 per 1000 gallons
    • Nonprofit Organizations $ 6.00 per 1000 gallons
    • Residential $ 6.00 per 1000 gallons
    • Water Dispensing Centre $ 6.00 per 1000 gallons
    • Recreational $ 6.00 per 1000 gallons
  1. SEWER SERVICE RATES

    Residential
    Single unit $36.00 per quarter
    Multi-unit $100.00 per quarter
    Trailer court $100.00 per quarter
     
    Commercial 1
    (Normal waste; low-volume being under 6,000 gallons of water consumption per quarter)
    Low-volume users $36.00 per quarter
    High-volume users $60.00 per quarter
     
    Commercial 2
    (Industrial waste; low-volume being under 6,000 gallons of water consumption per quarter)
    Low-volume users $ 60.00 per quarter
    High-volume users $ 100.00 per quarter
     
    Institutional
    (schools, hospital, nursing home)
    $150.00 per quarter
     
    Nonprofit
    (service clubs, churches)
    (low-volume being under 6,000 gallons of water consumption per quarter)
